Supreme Court Remands Pension Case to Court of Appeals

The Michigan Supreme Court has remanded the 2010 3% school employees pension lawsuit back to the Court of Appeals for further consideration. The Court of Appeals had originally ruled that the 2010 law was unconstitutional thus sending the case to the Supreme Court on appeal.  The Supreme Court has ruled that the replacement law from 2012 dealing with the same issue was constitutional.  The Supreme Court remand of the 2010 case to the Court of Appeals is for reconsideration based on the reasoning for the Supreme Court’s ruling upholding the 2012 law.
